breaking your lease

If you wish to terminate your lease agreement early you must notify your Property Manager in writing as soon as possible and you will need to complete an Ending a Tenancy Agreement Form (Form 13).

If you are to break lease, you will be responsible for paying the following fees:

  • Reasonable re-letting cost (usually 1 week’s rent plus GST)

  • Reasonable advertising costs (if incurred)

  • Compensation for loss of rent (until a new tenant is found or until the end date of the agreement - whichever happens first)

All keys (including any copies made) are to be returned to your Property Manager to finalise your vacate. You will be responsible for any rental payments up until a new applicant takes over your lease. Your Property Manager will keep in touch regarding the approval of a new tenant and the finalisation of your lease.

A vacate inspection will be conducted upon the completion of your tenancy. Providing the property has been left in satisfactory condition, all outstanding monies paid and owner approval, your bond will then be refunded to you promptly unless any deductions have been discussed.

Upon the end of your fixed-term tenancy agreement, your Property Manager will reach out three (3) months in advance with a lease renewal with the new lease period from the Lessor or a Notice to Leave Form (Form 12).

You must leave the property in the same condition it was in before you moved in, fair wear and tear excepted.

Remember to disconnect your electricity, gas, telephone and internet from your current property and re-direct your mail when you move out.

The tenant must complete an Exit Condition Report (Form 14a). It shows the condition of the property when you leave. If possible you should try to arrange a final inspection with your Property Manager.

The Property Manager must complete their side of the report, sign it and return a copy to you within 3 business days of receiving it.

As a tenant, you will need to:

  • Complete and sign the form

  • Take photos/videos to support your views

  • Remember to get a water meter reading (if you are being charged for water)

  • Extra pages should be added if there is not enough room on the report

  • Give a copy to the Property Manager

  • Keep a copy for your records

You get your bond back at the end of the tenancy as long as no money is owed to the property owner/manager for rent, damages or other costs.

You can apply on, or after, the handover day to have your bond money returned. You need to provide the RTA with your contact details, forwarding address and bank account details to receive your bond refund. You can update your details quickly and easily online using RTA Web Services.
